The Brazilian Supreme Court has overturned a ruling ordering the nationwide shutdown of the Facebook-owned WhatsApp instant messaging service, arguing that the move violated freedom of expression and communication.

Federal Supreme Court President “Ricardo Lewandowski” said in a decision that it seemed “scarcely reasonable or proportional” for a judge in Rio de Janeiro state to have ordered the indefinite suspension of the messaging app until it revealed encrypted messages pertaining to a confidential case.

WhatsApp celebrated the lifting of the ban. “We’re pleased that people can access WhatsApp again in Brazil,” a spokesperson said. “We hope that this puts an end to blocks that have punished millions of Brazilians and that people can continue using services like WhatsApp to stay in touch with those who matter to them.”

A Brazilian judge briefly blocked Facebook Inc’s WhatsApp messaging service on Tuesday for failing to cooperate in a criminal investigation, before the nation’s top court overturned the measure in the third such incident since December.

“It’s shocking that less than two months after Brazilian people and lawmakers loudly rejected blocks of services like Whatsapp, history is repeating itself,” he posted.

A Brazilian judge briefly blocked Facebook Inc’s WhatsApp messaging service on Tuesday for failing to cooperate in a criminal investigation, before the nation’s top court overturned the measure in the third such incident since December.

The app was blocked last December and again in May – affecting some 100 million Brazilian users of the service – by judges in different Brazilian cities but it returned to operation each time within 24 hours later via appeals court rulings.
